This website is owned and operated by Chloe Blue Scuba Diving Club. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors scuba diving courses, snorkeling and diving trips. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Key commercial Terms offered to customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
“The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Return and refund policy
​
For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: Mask and Snorkels, Regulators, Wetsuits or Swimming Costumes.

Retention of right to change offering
​
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Ownership of intellectual property, copyrights and logos
​
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Chloe Blue Scuba Diving Club. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Chloe King, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Chloe King assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time by emailing godive@chloebluescubadiving.com or clicking 'unsubscribe' on the email delivered.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [Name of Country / State], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in United Arab Emirates. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Membership T&Cs
​
Welcome to Chloe Blue! We are delighted to offer you access to a wide range of facilities, activities, and outlets operated by third parties, collectively referred to as "Venues." It's important to note that Chloe Blue does not own, operate, or control any of the Services offered at or through these Venues.

Membership Options and Conditions We provide different types of Memberships, including various subscription plans, non-subscription plans, and promotional plans. Each option may offer different products, activities, experiences, or services, and may be subject to additional terms, conditions, prices, policies, and limitations.

To be eligible for a Membership, you must be an adult of age 18 or above. Only individuals holding their own Membership can access diving facilities at any of the Venues.

Duration and Renewal Your Membership is valid for the duration you sign up for, unless it is earlier terminated or suspended by Chloe Blue, or by your request, or as otherwise permitted under these Terms. If you sign up for a subscription plan, you agree to automatically renew your Membership on the same terms as your initial signup, unless you terminate the Membership, it is otherwise terminated, or you opt out of auto-renewal before the renewal date.
Signing up for a Membership -
To purchase a Membership and become a Chloe Blue member ("Member"), you must sign up via our Website and provide all the required information. You must ensure that the information you provide at signup and throughout your Membership is truthful, accurate, current, and complete.

A valid email and mobile phone number that belongs to you are required for Membership signup. If your contact information changes, please update it on the Website.

Your Membership will begin once we receive your completed signup or reactivate a pre-existing Membership and the payment of the
Membership Fee is received. -
Using your Membership To use your Membership, you must add a clear profile photo of your face (without sunglasses, hats, or any other face coverings) to your account portal.

Please note that two dives are equivalent to one dive trip. You must book your dive trip at least 48 hours in advance. While using our Services, you are expected to behave with decorum and in a manner appropriate to the setting, following the rules and regulations of the respective Venues.

It's important to be aware that there is no rollover for missed dives each month.
Transferring your Membership -
If you hold a Membership with a 12-month prepaid subscription plan ("Annual Prepaid Membership"), you have the option to transfer your Membership to another individual ("Transferee") within the first 12 months. To initiate the transfer, please send an email to godive@chloebluescubadiving.com with all the required information to sign up as a Member. A joining fee of 150 AED is required for the transfer.

Upon receipt of the email, Chloe Blue will create an account for the Transferee within five days. The Transferor's Membership will be terminated on the day the Transferee's Membership commences, and the Transferee's Membership will expire on the same date as the Transferor's Membership was due to expire.
Terminating your Membership -
If you have a Membership with a subscription plan with monthly payments, you can terminate your Membership at any time by sending a request to godive@chloebluescubadiving.com. The termination will be effective from the date we receive your written request. Please note that no refunds will be given for the Membership Fee following the termination.

If you terminate a Monthly Membership within your commitment period, you are required to pay an early-termination fee equivalent to two months' Membership Fee. Exceptions to this fee will only be considered in the event of unforeseen relocation outside of the country due to job loss. Requests for early-termination fee waiver will be handled on a case-by-case basis, and you must submit supporting documentation, such as a redundancy notice from your employer with a company stamp and confirmed relocation travel plans.

Chloe Blue Scuba Diving Club reserves the right to terminate your Membership immediately and without notice if you fail to pay the Membership Fee prior to using the Services or if you breach any obligations under these Terms. In the event of termination by Chloe Blue or you, your access to our Services and all other features and products available through the Membership will be terminated as well.
Pausing your Membership -
Pausing your Membership will only be considered in the event of health issues that prevent you from using your Membership. Each request will be handled on a case-by-case basis, and you must provide supporting documentation, such as official medical reports.

Cancellation Policy for Diving, Snorkeling, and Other Excursions may be rescheduled due to bad weather. All dive/snorkel/excursions will commence as scheduled without further notice from Chloe Blue Scuba Diving.

Cancellations by Chloe Blue Scuba Diving, for any reason, will result in a 100% refund. Cancellations due to sickness must be justified in writing by a medical authority. Rainy or cloudy weather are not valid reasons for cancellation by the client; cancellations will strictly follow coastguard recommendations.

A "No Show" without prior notice is equivalent to a cancellation without notice. Cancellation within 72 hours prior to a booked dive will not result in a cash refund but instead will provide a voucher valid for 2 years. Cancellations without notice or same-day cancellations will not be eligible for a refund or voucher.

Guest Pass Some Memberships may offer a complimentary dive for a guest. Guest dive passes are only valid on weekdays and are not valid on weekends and public holidays. Guests must provide the necessary details to sign up for a Membership. All obligations under these Terms apply to Guests, and Members are liable for their Guests' actions when using our Services.

Fees, Billing, and Payment Fees for prepaid non-subscription and subscription plans must be paid in full upfront. Fees for subscription plans must be paid in monthly installments. The Membership fee must be paid at sign-up or renewal and in advance of using our Services.

Fees are payable in Arab Emirate Dirham (AED) and can be paid by debit or credit card. The credit card used for the initial payment will be kept on file for the duration of the Membership. If the payment from your default credit card declines, we may use any previously registered cards to make the payment. The owner of the credit card will be liable for any additional fees or charges applicable for the duration of the Membership.

We reserve the right to adjust pricing at any time, including introducing an initial joining and/or re-activation fee. Adjustments to pricing of your subscription will occur on your next billing cycle with notice communicated to you via various means. If you do not terminate your subscription, you agree to the adjusted fees.

Even if you do not use your Membership, you will be responsible for the Membership fees until you terminate your Membership or it is otherwise terminated. In the event of any increase in VAT or other sales or indirect taxes, Chloe Blue reserves the right to collect these taxes from the Member.

If we cannot charge your selected payment method for any reason, we will suspend your access to our Services until you settle all outstanding amounts. You will remain responsible for any uncollected amounts, and we will attempt to charge your credit card or any other payment method you have provided.
Prohibited Conduct As a Member, you agree not to engage in prohibited conduct, which includes but is not limited to:

Harassment or threatening behavior towards other members, staff, or Venues.

Acting in a deceptive or fraudulent manner.

Disrupting the enjoyment of other visitors at the Venues.

Allowing others to use your Membership.

Violating Venue rules and regulations.

Engaging in any unlawful activities.

Engaging in any activity that may harm the reputation of Chloe Blue.
Promotions and Offers Participation in promotions is subject to these Terms and any additional promotional terms and conditions. We reserve the right to terminate, extend, or remove promotions without prior notice.
